Judgment No. 3788
Decision
1. The impugned decision of 3 May 2011 is set aside to the extent that it recognised the complainant’s United States BSc degree without recognising the obligation to do so. 2. The calculation of the complainant’s reckonable previous experience and salary must be made with effect from 1 December 2007, with all consequential salary adjustments. 3. The EPO shall pay the complainant 6,000 euros in moral damages. 4. It shall also pay him 5,000 euros in costs. 5. All other claims are dismissed.
Summary
The complainant challenges the EPO’s refusal to apply its recalculation of his reckonable previous experience with retroactive effect to the date of his entry into service.
