It is his duty to put them into a form which clearly conveys to the official in precisely what way his rights are affected.     Extract:

    According to the organization "the decision impugned was taken by one of the governing bodies of the FAO in the exercise of its constitutional powers and represented a legislative enactment. [T]he term 'governing body' is not a term used in the constitution of the FAO and there is no definition of what it means." The Council is the executive organ of the Conference, which is the organization's supreme body. The Constitution gives the Council such powers as the Conference may delegate to it. "There is no assertion in the organization's reply of the delegation of any power that would justify the Council in depriving any official of any part of the salary to which under the Regulations he or she is entitled."

    The Administrative Council "defined its position as follows: 'The provisions of the Staff Regulations and other texts relating to the staff should so far as possible match those applicable to European Communities staff.' It appears clearly from this statement, the precise purport of which is indicated by use of the term 'so far as possible', that the Administrative Council did not decide to ensure full conformity between [its Staff Regulations] and those of the European Communities, that it entered into no legal commitment in that regard and that it merely made a statement of intent which did not provide for any sanction."

    Extract:

    The statement merely says that the Council has adopted a series of proposals the purpose of which is to bring the salary scales and related benefits in line with those applicable in the European Communities. "That is a mere statement of intent which did not imply any firm undertaking by the Institute and which consequently did not create rights upon which the staff may rely. Hence the complainant cannot rely upon that statement to support his claim to entitlement under the provisions applicable to the staff of the European Communities."

    Extract:

    It follows from Article XII of the Statute of the Tribunal "that the possibility of submitting the question of the validity of the decision given by the Tribunal to the International Court of Justice is exclusively vested in the governing body of [the Organisation] or the administrative board of the pensions fund, as is borne out by the court itself (advisory opinion dated 23 October 1956, ICJ reports, 1956, page 77 and pages 84-85). Such a possibility is open in the sole interest of the organisation [...]. Moreover, the exercise of this right must inevitably lead the governing body to take a stand on the validity of judgments rendered by the Administrative Tribunal."
